Army Regs On Homosexual Behavior

From The Soldier's Comprehensive Study Manual, 11th edition:

Q. What is the Army's separation policy for homosexual conduct?
A. Homosexual conduct, to include pre-service, prior service, or current service homosexual conduct, is grounds for separation from the Army under Chapter 15 of AR 635-200. (para 15-2a)

Q. What is the characterization of service for soldiers separated under the provisions of Chapter 15?
A. The type of discharge will reflect the character of the soldier's service. (para 15-4b)

NOTE: A discharge Under Other Than Honorable conditions is required if there is a finding that the soldier attempted, solicited, or committed a homosexual act under the following conditions:
-- By using force, coercion or intimidation.
-- With a person under 16 years of age.
-- With a subordinate in circumstances that violate customary military superior-subordinate relationships.
-- Openly in public view.
-- For compensation.
-- Aboard a military vessel or aircraft. (para 15-4a)

Under 16?  It is a crime under 18 in most states.

It is a crime under 18 in most states.

 

It is also a crime under the UCMJ but the regs quoted are the administrative rules for discharge and not the criminal code.
